Through use of this site and/or by making a purchase with it, you aknowledge that you have read and agree to these terms and conditions. Furthermore you warrant to the company that you are over the age of eighteen (18) years old and that you are intentionally and knowingly seeking access to products for your own personal use.

pure will never store customer credit card numbers, and will never charge your credit card without your express permission nor for any amount which you have not agreed to.

User Transmissions

Any material, information, idea or other communication you transmit to or post on this Site by any means will be treated as non-confidential and non-proprietary, and may be disseminated or used by Pure for any purpose. Pure will have no obligations to the creator of said content it will be free to copy, disclose, distribute, incorporate and otherwise use the content and all data, images, sounds, text, and other things contained therein for any and all commercial and non-commercial purposes. You are prohibited from posting or transmitting to this Site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any other material that could give rise to any civil or criminal liability under the law.

Except with regard to personal information, all information which you post on this site or communicate to Pure through this site (collectively “Submissions”) shall forever be the property of Pure. Without limitation, Pure shall have exclusive ownership of all present and future existing rights to any Submission of every kind and nature everywhere. You acknowledge that you are fully responsible for the message, including its legality, reliability, appropriateness, originality and copyright. You hereby represent and warrant that your Submission does not infringe the rights of any third party.

The copyright in all material provided on purecigs.com is held by Pure Cigs inc. except when otherwise noted. Except as stated herein, no material from the Site or any web site owned, operated, licensed or controlled by Pure, may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Any unauthorized use of any material contained on this Site may violate copyright laws, trademark laws, and other laws.

Trademarks

The trademarks, service marks and logos (the "Trademarks") used and displayed on this Site are registered and/or unregistered trademarks of Pure Cigs inc., unless otherwise noted.

Applicable Laws

This Site is controlled and operated by Pure Cigs inc. from its offices in Florida. Pure makes no representation that materials on this Site are appropriate or available for use outside of the United States. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. Any claim relating to, and the use of, this Site are governed by the laws of the State of Florida, without giving effect to any principles of conflicts of laws.

Liability

In no event shall Pure Cigs LLC be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of it's products.

Legal Compliance

Pure may suspend or terminate this Agreement or a User’s use immediately upon receipt of any notice which alleges that the User has committed fraud or used this site for any purpose that violates any local, state, federal or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault others, that may violate hacking or other criminal regulations, etc. of its agents, officers, directors, contractors or employees. In such event, Pure may disclose the User’s identity and contact information, if requested by a government or law enforcement body or as a result of a subpoena or other legal action, and Pure shall not be liable for damages or results thereof and the User agrees not to bring any action or claim against Pure for such disclosure.

Choice of Law and Forum

This site (excluding third party linked sites) is controlled by Pure Cigs inc. from its offices within the State of Florida, USA. It can be accessed from all 50 states as well as from other countries around the world to the extent permitted by location. By accessing this site, you agree that the statues and laws of the State of Florida shall apply to any actions or claims arising out of or in relation to this Agreement or your use of this site, without regard to conflicts of laws principles thereof. Pure makes no representation that materials on this site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. This Agreement shall not be governed by the United Nations Convention on Contracts for the Sale of Goods.

Warranty Policy

Pure Cigs offers a limited lifetime warranty on all beginner series kits against defects in material and workmanship under normal use and service for the product's lifecycle. The Pure Cigs beginner series lifetime warranty may only be used within 30 days of your last cartomizer purchase. Limit one piece of hardware per 2 packs of cartomizers.

The default warranty period for all other hardware is 14 days from date of purchase unless specified otherwise. Please test all products upon receipt. The warranty period expires whether you test it or not.

CARTOMIZERS, ATOMIZERS, TANKS, DRIP TIPS, ELIQUID, CLEARANCE ITEMS, FREE ITEMS, OR PROMOTIONAL ITEMS ARE NOT COVERED UNDER WARRANTY. NO EXCEPTIONS.

Exchanges will not be sent until the original parts are returned to us and evaluated. Return shipping is at the customers expense for parts returned to Pure Cigs LLC.

Products that are functional, not sold by Pure Cigs LLC, or determined to be outside of warranty or damaged by misuse will be returned without exchange.

Eligibility for repairs or exchanges are limited to products determined to have manufacturing defects of premature failure. Products that are damaged through misuse, negligence, abuse or modified or repaired by anyone other then Pure Cigs LLC are not eligible for exchange.

All warranty exchanges require prior approval and must be accompanied with a completed RMA form. Failure to obtain prior approval for you exchange may result in delay or rejection. Please list all items being sent back and provide a full description of any defect along with your return address, telephone number, and legible proof of purchase.

We are not responsible for damage or loss incurred as a result of postal handling including lost or misdelivered packages. We recommend all returns and exchanges be delivered via a verifiable shipping method and packed in a padded bubble mailer.

Pure Cigs reserves the right to deny claims at its sole discretion.

Shipping Policy

All in-stock orders are processed every morning Monday through Friday. This means that orders placed on Thursday at 2pm EST and Friday at 2am EST will both ship on Friday morning, but an order placed on Friday at 5pm EST will not ship until Monday morning. Please understand and anticipate this delay.

All orders are shipped from our warehouse in Melbourne, FL. For shipments within Florida, especially if you are physically closer to Melbourne than to Orlando, we highly recommend you do not select airmail shipping options. UPS will actually automatically downgrade unnecessary airmail shipments to ground service, but USPS will still send it to Orlando International Airport for routing on a flight that it will never take often causing slower service while still charging premium airmail fees.

Shipping estimates are estimates from the carrier based on when it is handed off to the carrier, not when you place the order. Again, that means an order placed on Friday at 5pm EST with a shipping service estimating 1-2 days delivery time is based on a handoff to the carrier on Monday, not from the time you placed the order on Friday.

We make no guarantees of estimated delivery times by shipping companies, as we do not own or control the shipping companies. We do not extend money-back guarantees made by the carriers, especially the USPS Express money-back guarantee which they have deliberately crafted to make claim process cost more than the refund being requested.

We do not take responsibility for the loss, theft, damage, or delayed shipment of any orders shipped by USPS. All orders are fulfilled to the shipping address provided during checkout, and we take no responsibility for typographical errors in entering your own address during checkout. We will not be held responsible for lost or failed deliveries made to incorrect addresses or other occurences outside of our control.

All shipping charges are non-refundable.

Free Shipping

Free shipping minimum applies to order products including discounts but not including tax. Only the cheapest available shipping method will be used for free shipping.

Delivery Confirmation Policy

Because a variety of instances beyond our control may occur at your shipping address, you agree that any delivery confirmation (even those that do not include a signature) provided by the selected shipping provider is deemed sufficient proof of delivery to the credit card holder.

Order Cancellation or Modification

Once an order has been marked as 'In Preparation' or 'Shipped' it may not be cancelled or modified. Requests for order modification may be fulfilled only if order has not yet been shipped. Order modifications effecting total price will require cancelling and reordering.

Return Policy

Due to the consumable nature of our products, Pure Cigs does not accept returns or issue refunds of any kind.

Fulfillment Errors

Requests to correct fulfillment mistakes that are made by Pure Cigs LLC resulting in your receipt of incorrect or missing items in your order will be accepted for 48 hours after the receipt of your order.

Requests for missing or incorrect items will not be accepted after 48 hours from the date you have received your order.

Please inspect your order immediately upon receipt and if you feel there is an error please contact customer support.

Revisions

Pure may revise these Terms of Use at any time. Orders placed prior to this modification date remain covered by policies in effect at that time. By using this Site, you agree to be bound by any such revisions.
